Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Racket Ready Ankles Programme (the "Programme") and the website at racketready.upliftphysio.co.uk (the "Site"), provided by Uplift Physio® ("we", "us", "our"). By purchasing, accessing or using the Programme or Site, you agree to be bound by these Terms. If you do not agree, please do not use the Programme or Site.

Important health & medical disclaimer The Programme is an educational and training resource. It is not medical advice, diagnosis, or treatment, and it is not a substitute for an individual consultation with a qualified healthcare professional. Always consult your doctor or a qualified physiotherapist before starting any exercise programme, particularly if you have a current or recent injury, pain, a medical condition, or any doubt about your fitness to exercise. By taking part you accept that exercise carries inherent risks and that you do so at your own risk. Stop immediately and seek professional advice if you experience pain, dizziness, or discomfort. If you have acute pain, a fresh injury, or a medical concern, please book a personalised consultation with our physiotherapists or another qualified clinician.

1. Who we are

The Programme is provided by Uplift Physio® [insert registered company name, e.g. Uplift Physio Ltd], a company registered in England and Wales [company number: insert], with clinics in Manchester and Altrincham. You can contact us at info@upliftphysio.co.uk.

2. The Programme

The Programme is a digital educational product for racket sport players, comprising a framework, guided video exercises, a bonus plyometrics section, and supporting materials. It is delivered online through our third-party course platform (Thinkific). We may update, improve, add to, or modify the content of the Programme from time to time. We aim to keep the Programme available but do not guarantee uninterrupted access.

3. Eligibility

You must be at least 18 years old to purchase and use the Programme. By purchasing, you confirm that you are 18 or over, are physically able to take part in an exercise programme, and have read and understood the health and medical disclaimer above.

4. No guarantee of results

Every person's body, history, and circumstances are different. While the Programme is built on protocols we have used successfully with athletes, we make no guarantee of any specific result, outcome, recovery time, or performance improvement. Testimonials and examples on the Site reflect individual experiences and are not promises of the results you will achieve.

5. Pricing & payment

The Programme is available as a one-time lifetime access purchase or a monthly subscription, at the prices shown at checkout. Promotional or discounted pricing may be available for a limited time and may change or be withdrawn without notice. Payments are processed securely by our platform and payment providers (Thinkific and its payment processors); we do not store your full card details. All prices are in GBP and include applicable taxes unless stated otherwise.

6. Subscriptions, renewals & cancellation

If you choose the monthly subscription, your payment method will be charged automatically each month until you cancel. You may cancel at any time; cancellation stops future payments, and you will retain access until the end of your current paid period. To cancel, contact us at info@upliftphysio.co.uk (or use any self-service cancellation option provided). Lifetime access is a single payment granting access for the operational lifetime of the Programme.

7. Right to cancel & refunds (digital content)

Under the UK Consumer Contracts Regulations, you normally have a 14-day right to cancel a purchase. However, because the Programme is digital content supplied online, by purchasing and accessing it you agree that we begin supplying it immediately and you acknowledge that your 14-day right to cancel is lost once access has begun. Beyond your statutory rights, our refund policy is: [insert your refund policy — e.g. "no refunds once the Programme has been accessed", or "30-day money-back guarantee"]. Nothing in these Terms affects your statutory rights as a consumer.

8. Your account & access

Access to the Programme is personal to you. You are responsible for keeping your account login details confidential. You must not share, sell, transfer, or provide access to your account or the Programme content to any other person.

9. Intellectual property

All content within the Programme and on the Site — including videos, text, exercises, frameworks, graphics, and branding — is owned by or licensed to Uplift Physio® and is protected by copyright and other intellectual property laws. You are granted a limited, personal, non-transferable, non-commercial licence to access and use the content for your own use only. You must not copy, reproduce, distribute, publish, screen-record, resell, or otherwise exploit any part of the Programme without our prior written permission.

10. Acceptable use

You agree not to misuse the Site or Programme, including by attempting to gain unauthorised access, distributing the content, or using it for any unlawful purpose. We reserve the right to suspend or terminate access, without refund, where these Terms are breached.

11. Third-party services

The Programme and Site rely on third-party platforms (including Thinkific for hosting and checkout, and Klaviyo for email). Your use of those services may also be subject to their own terms and privacy policies. We are not responsible for the acts, omissions, or availability of third-party services.

12. Limitation of liability

To the fullest extent permitted by law, we are not liable for any injury, loss, or damage arising from your use of, or inability to use, the Programme or Site, including any loss arising from performing the exercises. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot lawfully be excluded. You take part in the exercises voluntarily and at your own risk.

13. Privacy

We process personal data in accordance with our Privacy Policy and applicable data protection law (UK GDPR). By subscribing to our emails you consent to receive communications from us; you can unsubscribe at any time.

14. Changes to these Terms

We may update these Terms from time to time. The version published on the Site at the time you access the Programme applies. We will update the "Last updated" date when changes are made; continued use of the Programme after changes constitutes acceptance.

15. Governing law

These Terms are governed by the laws of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
